ROE V WADE, CONSTITUTIONAL RIGHT?
Which constitutional provision guarantees a right to an abortion?
Are you tired of claims that Roe v Wade represents a constitutional right to an abortion? Do we know what a, “constitutional right,” is?
Every constitutional right is either stipulated in the text of the original Constitution, or it is contained in an amendment to the Constitution, or it is stated in a statute. Either way, ALL constitutional rights must be spelled out in our existing Constitution.
Words have meanings? Shouldn’t we make sure we understand the actual definition of terms before we accept, and repeat them?
What exactly is, “Roe v Wade?” Is it the name of a congressional bill? Was this bill passed by Both houses of Congress, then signed into law by the President? This is the definition of a, “law.” If this has not happened regarding abortion, there is no such law. The Supreme Court does not create law, or determine law, it judges according to the law, the laws that have been made via the afore mentioned process.
Article 1, Section 1, “All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives.”
Article 1, Section 7, “…Every Bill which shall have passed the House of Representatives and the Senate, shall, before it become a Law, be presented to the President of the United States; If he approve he shall sign it…” This is the only process for, “making laws.”

“Roe v Wade,” is the name of a court case that was adjudicated, ascending all the way to the Supreme Court.

What law was being adjudicated in the “Roe v Wade,” case? In what way can we assert that the results of a court decision constitutes a law? If there is no law legalizing abortion, how can a court case establish one?
It cannot.
Some believe that a lie told often, and confidently enough will become truth. I contend that a lie is a lie, no matter who states it, no matter how loudly, or how often they state it, and the only way that it becomes known as truth is that those who know the truth, do not defend it.
Not only is, “Roe v Wade,” simply a court decision, it is one that was arrived at improperly, and this is exactly what has been determined by the majority of our present Supreme Court, according to the leaked 1st draft opinion of Justice Alito.
Why do many Americans believe that Supreme Court decisions ARE THE LAW? What are the specific duties, and authorities of the Court?
Article III, Section 2, “The judicial Power shall extend to all Cases, in Law and Equity, arising under this Constitution, the Laws of the United States, and Treaties made, or which shall be made, under their Authority;—“
As you read this, please note that the basis for the determination of THE LAW, is the US Constitution, the Laws of the United States. From where do these Laws of the United States come? They originate in the Congress, Article 1, section 1, (see link above.)
Many Americans don’t believe that it is this simple. We have been misled to believe that we need some “expert, or experts” to tell us what the Laws of the United States are, and we are expected to believe that the nine judges, appointed to the Supreme Court are those, “experts.”
Nothing can be further from the truth. Most of us are capable of fundamental reading comprehension? Like the Bible, our Constitution was intended to be understandable to the average person, a matter of common sense, integrity, and virtue. In that case, most of us are uniquely qualified to determine the truth of American law for ourselves, unless we are without integrity. The function of the court, and especially the Supreme Court, is to adjudicate between those in fidelity with constitutional law, and those who seek to subvert it. The court’s function is to be aware of the fundamental objectives of the written law, and the wisdom to apply it to various contemporary situations. Much like when King Solomon was called upon to judge between the two women who both claimed to be the mother of a particular baby. The king’s duty was to determine which of the two was the mother. They could not both be the baby’s mother. His judgement was not to determine the most compelling argument, but to determine which of the women was the real mother. The wisdom exercised was to compel the women to show their true motives, and judge accordingly.
Likewise, our Constitution requires our judicial system to determine who’s argument is representative of the truth, not who has made the most compelling argument.
If our members of Congress are constrained by integrity, they construct virtuous laws, and virtuous judges will rule virtuously, but if reprobates are elected to the positions where judges are appointed, then we will experience miscarriages of justice.
It is the duty of the American citizen to insist on righteous judgements. Tyrants can not reign tyranny in America without being given that power by, “the people.” Have the American people chosen to give this power to the Court, or have they been deceived? Has this power been wrested from the people by despotic court justices, and tyrannical Executives?
My goal is to help inspire my fellow Americans to reject the lack of integrity that we so often find in our government, and insist upon virtue.
If the majority of Americans want to allow abortions, all that is needed is for one of the many Congress-persons, in either house, to propose such a bill, and once passed in both houses, it can be presented to the President for signing into law. Abortion then would be the law of the land, and thereby a constitutional right. This has never happened, and therefore, there is no law granting a right to an abortion.
I believe that if such was the will of a majority of Americans, it would be so. Since it is not, I believe that it is not possible, and thus it is not the will of the people. So a minority of Americans, intolerant of opposition, seek to force their will upon the majority , and have prevailed for forty-nine years.
Does it bother you that the very suggestion that this judicial sleight of hand might be corrected has brought on such vicious enmity? Do you not find it revealing to see how much violence is acceptable, to so many, and to whom it is acceptable?
These are revealing times, and we should take note who stands where.
God bless you, Dave
